Lasting Power of Attorney Services
Do You Need Help to Make and Register a Lasting Power of Attorney?
If you reside in England and Wales you can make and register a Lasting Power of Attorney (LPA). It is a legal document that allows someone like a close family member or friend to have the right to make financial or health and care decisions on your behalf if you should lose mental capacity and be unable to manage your own affairs.
If you reside in Scotland you must contact the Office of the Public Guardian for Scotland and if you reside in Northern Ireland you must contact nidrect.
Types of Lasting Power of Attorney
There are two kinds of Lasting Power of Attorney (LPA) you can apply for:
LP1H - Health and Care Decesions - The type of medical treatment you would choose and receive, day-to-day care and where you live.
LP1F - Financial Decisions - Managing your finances, paying bills and property.
Who is Involved in Making a Lasting Power of Attorney?
The following people are required to make both kinds of Lasting Power of Attorney (LPA):
The Donor - this you and must be over 18 years old, have the mental capacity to do so and must reside in England or Wales. If you need to make an LPA for financial decisions and are bankrupt or subject to a debt relief order (DRO) you are advised to contact the Office of the Public Guardian for England and Wales for further information before you proceed This would not apply to making an LPA for health and care decisions.
The Certificate Provider - Is a close friend or colleague who you have known well for over 2 years and is over 18 years old. A certificate provider is an impartial person who can confirm that you understand what you’re doing and nobody is forcing you to make and register an LPA.
